Terms and Conditions

These SMS/Text Messaging Terms and Conditions (“Terms”) govern the delivery and receipt of SMS and MMS messages sent by SSA GROUP, LLC (“SSA GROUP,” “we,” “us,” or “our”) to the mobile phone number you provide (“you” or “Subscriber”). By opting in to receive text messages from SSA GROUP you expressly consent to these Terms. If you do not agree, do not opt in or respond to any SMS message. 

  1. Program operator and contact information 
  • Program operator: SSA GROUP, LLC 
  • Message sender / short code / phone number: [INSERT SHORT CODE OR PHONE NUMBER]

  1. Consent to receive messages 
  • By providing your mobile phone number and opting in, you expressly consent to receive recurring automated promotional and/or informational text messages and/or multimedia messages from or on behalf of SSA GROUP at the mobile number you provide. 
  • Consent is not a condition of purchase. You represent and warrant that you are the account holder or authorized user of the phone number provided. 
  1. How to opt in 
  • Web/online: By completing an online form and checking the opt-in box. 
  • In-person: By signing a written form that includes an opt-in disclosure. 
  • SMS: By texting the program keyword (for example, JOIN or START) to the short code or phone number provided. 
  • Other methods: As described in the specific opt-in disclosure you received. 
  1. Opt-in disclosure 
  • By opting in you agree to receive recurring automated promotional and informational text messages from SSA GROUP, LLC at the mobile number provided. Msg & data rates may apply. Message frequency may vary. Reply STOP to unsubscribe, HELP for help. See our Privacy Policy for details. 
  1. Confirmation and double opt-in 
  • Upon opt-in we may send a confirmation message and may require a reply to confirm your opt-in (double opt-in). Example confirmation message: “Welcome to SSA GROUP alerts. Msg & data rates may apply. Reply STOP to cancel, HELP for help.” 
  • Do not opt in if you do not want to receive these messages. 
  1. Message types and frequency 
  • Messages may include: promotional offers, product updates, order confirmations, delivery or appointment reminders, account alerts, surveys, and other informational or marketing messages. 
  • Expected frequency: up to [INSERT NUMBER] messages per month. Actual frequency may vary by program and your interactions. 
  1. Message & data rates; device requirements 
  • Message and data rates may apply to messages sent to or received from SSA GROUP, as provided by your wireless carrier. 
  • You are responsible for all carrier fees and charges. SSA GROUP is not responsible for any charges assessed by your carrier. 
  • Not all carriers and devices support SMS/MMS. Message delivery may be affected by your device settings, network coverage, or carrier limitations. 
  1. How to get help or stop messages 
  • STOP: Reply STOP to any message to unsubscribe from the program. After you reply STOP, we will send a final confirmation message and you will receive no further messages unless you opt in again. 
  • HELP: Reply HELP to any message for help or additional information. For additional assistance contact support at info@thessagroup.com
  • We will make reasonable efforts to process STOP and HELP requests promptly, but some requests may take a short period to fully process. 
  1. Privacy and data use 
  • We collect and use your information as described in our Privacy Policy. By opting in, you consent to SSA GROUP’s use and disclosure of your information consistent with the Privacy Policy, including sharing with third-party service providers who assist in delivering and processing the SMS program. 
  • We will not sell your mobile number except as permitted by applicable law and our Privacy Policy, and you may request deletion as described in the Privacy Policy. 
  1. Third-party providers and carriers 
  • SSA GROUP may use third-party service providers (e.g., SMS gateway providers, analytics providers) to deliver messages and process opt-ins and opt-outs. 
  • Wireless carriers are not liable for delayed or undelivered messages. 
  1. Prohibited uses 
  • You agree not to use this service in a fraudulent, unlawful, abusive, or harassing manner. 
  • You must not provide false information or sign up phone numbers without the owner’s consent. 
  1. Intellectual property 
  • All content delivered via SMS or contained in these messages is owned by or licensed to SSA GROUP and protected by copyright, trademark, and other intellectual property laws. 
  1. Disclaimer of warranties 
  • THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” SSA GROUP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 
  1. Limitation of liability 
  • TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SSA GROUP, LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THESE TERMS OR THE SMS PROGRAM. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF $[INSERT AMOUNT] OR THE AMOUNTS YOU PAID SSA GROUP IN THE PRIOR [INSERT NUMBER] MONTHS. 
  1. Indemnification 
  • You agree to indemnify, defend, and hold harmless SSA GROUP, its affiliates, officers, directors, employees, agents, and service providers from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the SMS service. 
  1. Changes and termination 
  • SSA GROUP may modify these Terms or discontinue the SMS program at any time. If we make material changes, we will provide notice where required by law. Continued use after notice constitutes acceptance of revised terms. 
  • We reserve the right to suspend or terminate your participation in the SMS program for any reason, including suspected misuse or noncompliance with these Terms. 
  1. Governing law and dispute resolution 
  • These Terms are governed by the laws of Colorado, USA. Any dispute arising under or relating to these Terms will be subject to the jurisdiction of the state or federal courts located in Colorado. 
  1. No emergency communications 
  • Do not use the SMS service for emergency or time-sensitive matters. If you have an emergency, call local emergency services immediately. 
  1. Minors 
  • The SMS program is not directed at children under [INSERT MINIMUM AGE PER JURISDICTION]. By opting in you represent that you are of legal age to consent or that you have parental or guardian consent where required. 
  1. Miscellaneous 
  • Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. 
  • Entire agreement: These Terms together with any documents expressly incorporated by reference (including the Privacy Policy) constitute the entire agreement between you and SSA GROUP regarding SMS communications. 
  1. Sample opt-in and confirmation language 
  • Website opt-in label example: “Sign up for SMS alerts from SSA GROUP, LLC. By checking this box you agree to receive recurring automated marketing and informational text messages from SSA GROUP at the phone number provided. Msg & data rates may apply. Reply STOP to unsubscribe. See our Privacy Policy.” 
  • Confirmation SMS example: “Welcome to SSA GROUP alerts. Msg & data rates may apply. Reply STOP to cancel, HELP for help.” 
  1. Questions 

The publicly accessible URL that contains the Terms & Conditions for SMS. The Terms and Conditions must have an SMS disclosure that includes the types of messages consumers can expect to receive, texting cadence, message and data rate notices, privacy policy links, HELP information, and opt-out instructions. The URL can be a webpage or an online file that is publicly accessible.
